These general conditions regulate the acquisition of the services offered on the website www.tripuniq.com, which is owned by A2C TRAVEL, S.L. (hereinafter TRIPUNIQ).
The acquisition of any of the services implies the full and unreserved acceptance of each and every one of the general conditions indicated, without prejudice to the acceptance of the particular conditions which may be applicable when acquiring certain services.
These general conditions may be amended without prior notice, therefore, it is advisable to carefully read its contents before proceeding to the acquisition of any of the services offered.
TRIPUNIQ, in compliance with law 34/2002 of 11 July, on information society and e-commerce services, informs you that:

All notifications and communications between experts and TRIPUNIQ shall be considered effective, for all purposes, when carried out through any means detailed above.
The services offered by TRIPUNIQ consist of connecting travelers with people from the area they want to travel to.
The main service is the "tailor-made guide" whereby local people (local experts or local Hero) make a guide tailored to the preferences of the traveler. The local expert makes a plan for each day as the traveler wishes with general recommendations of the destination, typical dishes of the area and events that take place on the dates of the trip.
Local experts can offer extra services that can be hired together with the main service or later, provided that it is before the date of the trip. Some of the most common extras are:
-"Welcome Meeting" Service: The local expert and the traveler are quoted at the arrival of the traveler to the destination country so that the first one explains in person to the second the details of the plan.
-"Message Assistance" service: The expert agrees to be available to answer questions via telephone or WhatsApp during the days of the trip.
-Other Extras: The local expert can offer any other extra services that he deems interesting to the client.
-There is the possibility of hiring an express service in case the client requests the preparation of a guide for a trip to be made in less than 48 hours. The hiring of this service carries a surcharge in the price.
TRIPUNIQ reserves the right to decide, at any time, the products and/or services offered to customers. In this way, TRIPUNIQ may, at any time, add new products and/or services to those currently offered. Likewise, TRIPUNIQ reserves the right to withdraw or stop offering, at any time, without prior notice, of any of the services offered.
Once at www.tripuniq.com, and wants to access the hiring of the different services, the user must follow all the instructions indicated in the process of purchase, which will imply the reading and acceptance of all the general and particular conditions Fixed in www.tripuniq.com.
4. AVAILABILITY AND SUBSTITUTIONS
The service is requested through the platform following the process established on the website or by downloading the mobile app available on IOS and Android.
In the event that the local expert is not able to make the requested plan, either because we do not have available an expert in the requested destination or because the expert refuses to make the plan for personal reasons, we will try to make a substitute expert available to the traveling user. In the face of the inability to find a substitute expert, the customer will be notified as soon as possible and the full amount paid for the service will be refunded.
If the expert does not deliver the plan within the foreseen period, a substitute expert will be sought to make a new one, informing the client, which may accept the delay in plan delivery or cancel the service, returning TRIPUNIQ the full amount paid.
If the expert can deliver the guide but may not perform any of the extra services contracted, the customer, depending on the availability, may opt for such service to be performed by another expert or the refund of the amount charged by said Service.
TRIPUNIQ is not responsible for any damages or losses that may occur to the user resulting from failures or disconnections in the telecommunications networks and which causes suspension, cancellation or interruption of the hiring process through the www.tripuniq.com online platform
5. PURCHASING PROCESS AND/OR PROCUREMENT
To make any purchase at www.tripuniq.com, it is necessary that the customer is of legal age.
In order to make a purchase, you need to follow the steps below:
1. Indicate the destination to which you want to travel.
2. Fill out the questionnaire about the trip that appears on the screen.
3. After completing the questionnaire, TRIPUNIQ selects a local expert and presents it on the screen to the user alongside the information and price per day. Depending on the expert, it will also offer the possibility of hiring extra services.
4. If the user is satisfied with the information and price offered, he will proceed with the registration, indicating his personal details and the payment of the service.
5. Once the payment has been made, the user will receive an email with the confirmation of the contracted service and we will put him in contact with the local expert through a messaging system to finalize the details.
It is also advisable that the customer print and/or keep a copy in durable support of the terms of sale when ordering, as well as proof receipt sent by TRIPUNIQ via email.
The invoice or receipt is sent to the user with the purchase confirmation email.
6. DURATION, RENEWAL AND CONTRACT TERMINATION
- DURATION: The relationship between TRIPUNIQ, the client and the local expert concludes the month following the completion date of the customer's trip, unless the customer had made any claim for the service provided, in which case it will terminate when satisfactorily for all the parties said claim.
- CANCELLATION: TRIPUNIQ may cancel the service due to violation of these conditions by the expert or the customer. The customer may, on his part, cancel the service for unavailability of an expert or services contracted if any of the cases listed in paragraph 4 are given. "Availability".
Once the expert has prepared the plan, the customer receives a notification by email so that he can view it in a guide form, either through the website or through the app. This app offers the user the option of copying all the contents of the guide, including maps, onto the mobile so that they are available in case the traveler does not have data service at the destination. If the customer deems it necessary, you can ask the expert to make minor changes to the plan or add any details.
If the trip is carried out in a couple, group, etc. the client can share the guide with a maximum of 10 people using the procedure indicated on the Web and app before the travelling date. All travelers have the guide at no extra cost. To do this, the main traveler will facilitate through the platform the email address of the rest of travel companions so that TRIPUNIQ sends a link through which they will download the guide or share the link through the mobile if they will use the app.
The e-mail addresses provided by the principal traveler so that his/her travel companions receive the link for downloading the guide will be understood as data communicated with the consent of the data holder.
The customer may not reproduce, disclose or share the content of the guide with third parties for commercial purposes or distribute it freely for their own benefit
8. PRICES, EXPENSES AND TAXES
The prices of the services that are collected in www.tripuniq.com will be expressed in Euros unless otherwise stated and will be guaranteed during the validity period of the same, except printing error and whatever the destination of the order.
PRICE OF SERVICES
-Main Service "tailor-made guide": The price is the amount per day contracted that appears on screen.
-Extra Service "Welcome meeting": can be a fixed price or depend on the number of days hired. Appears on the screen.
-Extra Service "message assistance": The price of this service is variable based on the number of days of travel. Appears on the screen.
-Express Service: emergency surcharge will be applied to the price of the services contracted. The customer will be informed on the screen of the amount.
-Additional services: The customer will be informed on the screen of the service and price.
The final prices of all services, together with their characteristics, offers, discounts, etc. are reflected in each of the services offered in www.tripuniq.com.
- The services have the VAT included. The VAT applied is 21%.
- There are no additional expenses except those of the extra services contracted.
The prices of the services may vary at any time. In this case, the price to be applied will be the one in effect in the date of the fulfillment of the order. In any case, the final cost will be communicated to the customer in the electronic purchase process before it formalize its acceptance.
9. FORMS OF PAYMENT
We offer the following forms of payment:
A) Credit or debit card: You can make the payment immediately through the secure payment gateway SSL stripe. If it is necessary to make any return or cancellation of the order, the amount will be reimbursed through the same payment card. Personal and bank data will be protected with all security measures established by the Organic Law on Data Protection 15/1999 and its development regulations with total confidentiality.
B) PayPal: The payment of the order will be authorized through PayPal, but no money will be withdrawn until PayPal verifies that it is correct. To do this, it will be essential to have PayPal account.
10. RETURN AND WITHDRAWAL POLICY
According to the regulations, we inform the user that there is a right to desist from the contract for a maximum period of 14 calendar days without the need to indicate the reason and without incurring any cost, except those provided for in article 107.2 and 108 of the RD1/2007, of 16 November, whereby approves the referred text of the General Law for the defense of the consumers and users.
However, based on the exception of Article 103. Subparagraph (c) of RDL 1/2007 of 16 November approving the General Law for the defense of consumers and users this withdrawal right does not apply to:
Contracts for the supply of products made according to the specifications of the consumer and user or clearly customized.
Therefore, the withdrawal right cannot be applied to the services provided by TRIPUNIQ, since the travel plans developed by the local experts are carried out under the instructions and preferences specified by the client in their application so that they are totally personalized services.
Without prejudice to the foregoing, TRIPUNIQ, as set out in paragraph 4. "Availability", will substitute the Local expert hired when the latter does not provide the services with the quality or deadline requirements established or return the full amount paid by the customer.
TRIPUNIQ guarantees the delivery of the guide with adequate levels of quality and within the established deadlines. If any of these requirements are not fulfilled, the full amount of the purchase will be returned to the customer.
12. RESPONSIBILITY AND EXONERATION OF LIABILITY
TRIPUNIQ selects its local experts to meet minimum quality requirements in the delivery of its services, however, TRIPUNIQ is not responsible for the content of the guidelines made by them or the recommendations made by the expert to the traveler on the places to visit, where to eat or activities to make.
TRIPUNIQ may suspend, withdraw or cancel partially or completely the services under contract at any time and without the need for prior notice. The above forecast will not affect those services that are reserved for registered users or who are subject to prior recruitment and which shall be governed by their specific conditions.
13. CUSTOMER SERVICE AND CLAIMS
Customers can contact TRIPUNIQ when necessary to resolve any questions or queries.
A few days after the end of the trip, TRIPUNIQ contact the client to ask for an assessment of the local expert and the services provided in order to control the quality levels.

According to the resolution of online disputes regarding consumption of the EU and pursuant to article 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online litigation resolution platform that is available at the following link: http://ec.europa.eu/consumers/odr/.
14. APPLICABLE LEGISLATION
The conditions present will be governed by the Spanish legislation in force.
The language used will be Spanish, English, French and Italian.
